General Terms and Conditions
§ 1 Scope of Application
These General Terms and Conditions apply to all contracts between Digital Freedom and Rights gUG (haftungsbeschränkt) i. G. and its customers or participants concerning online courses, eLearning, live online trainings, workshops, events, and related educational services.
All official communications regarding these services are issued by Digital Freedom and Rights gUG (haftungsbeschränkt) i. G., also operating under the name DFR Foundation.
§ 2 Registration and Conclusion of Contract
Registration may take place through the DFR Foundation website, online forms, email, or other registration channels provided by DFR Foundation.
By submitting a registration or completing a purchase, the participant makes a binding request to participate in the selected course, training, workshop, or event. A contract is concluded once DFR Foundation confirms the registration or provides access to the course or learning materials.
DFR Foundation reserves the right to reject registrations or cancel courses if minimum participation numbers are not reached or if there are important organizational, technical, or legal reasons.
§ 3 Participation Fees and Payment
Participation fees are listed on the respective course or registration page. Unless stated otherwise, prices are final prices.
If Digital Freedom and Rights gUG (haftungsbeschränkt) i. G. applies the small business regulation under § 19 UStG, no VAT will be charged. Otherwise, statutory VAT will be shown where applicable.
Payments for live courses, online courses, workshops, or events are due according to the payment terms stated during registration or on the invoice. Unless otherwise agreed, invoice payments are due within seven days of receipt of the invoice.
§ 4 Course Delivery
Courses may be delivered as live online sessions, eLearning modules, in-person workshops, hybrid events, recorded trainings, or other educational formats.
DFR Foundation reserves the right to make reasonable changes to course content, trainers, schedules, course structure, technical tools, or location where necessary. Participants will be informed of material changes as early as reasonably possible.
For online sessions, participants are responsible for having suitable technical equipment, a stable internet connection, and access to the required software or platforms. DFR Foundation is not responsible for technical problems caused by the participant’s equipment, internet connection, or third-party systems outside DFR Foundation’s control.
§ 5 Cancellation by Participants
Participants may cancel their registration by sending written notice by email or post to:
Digital Freedom and Rights gUG (haftungsbeschränkt) i. G.
Friedrich-König-Weg 5
90513 Zirndorf
Germany
Email: Jazzi@dfrfoundation.com
Unless otherwise stated on the course page, the following cancellation rules apply:
For on-site courses or in-person events, cancellation is free of charge up to four weeks before the start of the course.
For online courses or live online trainings, cancellation is free of charge up to two weeks before the start of the course.
For cancellations after these deadlines, DFR Foundation may retain the participation fee. However, DFR Foundation may offer a transfer to another course date at its discretion.
Participants may request to transfer their registration to another person before the course starts, provided that the replacement participant meets any course requirements.
§ 6 Cancellation or Rescheduling by DFR Foundation
DFR Foundation reserves the right to cancel, postpone, or reschedule a course, training, workshop, or event due to insufficient registrations, trainer unavailability, illness, technical problems, force majeure, or other important reasons.
In such cases, participants may choose between a full refund or transfer to a new course date. Further claims are excluded unless required by law.
§ 7 Conduct of Participants
Participants are expected to behave respectfully and professionally during all courses, workshops, and events.
DFR Foundation may exclude participants from a course or event if they seriously disrupt the learning environment, violate confidentiality obligations, misuse access links or materials, engage in abusive or discriminatory behavior, or violate applicable laws.
§ 8 Intellectual Property and Course Materials
All course materials, slides, recordings, templates, documents, exercises, and other educational content remain the intellectual property of DFR Foundation or its licensors unless expressly stated otherwise.
Participants may use the materials only for their own personal learning purposes. Reproduction, publication, resale, redistribution, commercial use, or sharing with third parties is not permitted without prior written consent from DFR Foundation.
§ 9 Certificates and Learning Outcomes
Where applicable, DFR Foundation may issue certificates of participation or completion.
Such certificates confirm participation or completion only. They do not guarantee employment, professional qualification, certification by a third-party body, legal compliance, or achievement of a specific security or organizational outcome unless expressly stated in writing.
§ 10 Liability
DFR Foundation is liable according to applicable statutory provisions for intent, gross negligence, injury to life, body, or health, and any liability that cannot be excluded by law.
For other cases, liability is limited to foreseeable and typical contractual damages. DFR Foundation is not liable for participant-side technical issues, loss of internet access, misuse of course content, or decisions made by participants based on educational content.
Courses are provided for educational and informational purposes only.
§ 11 Consumer Withdrawal Rights
If the participant is a consumer within the meaning of applicable law, statutory withdrawal rights may apply.
For digital content, eLearning materials, recordings, or immediate access to online learning content, the right of withdrawal may expire if the participant expressly agrees that access begins before the end of the withdrawal period and confirms knowledge that the right of withdrawal is lost once access begins.
§ 12 Dispute Resolution
DFR Foundation is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final Provisions
German law applies, subject to mandatory consumer protection provisions.
If the customer is a merchant, a legal entity under public law, or a special public fund, the place of jurisdiction shall be Nuremberg, Germany, where legally permissible.
If individual provisions of these Terms are invalid, the validity of the remaining provisions shall remain unaffe.
